Tough Choice is a decision-support and educational tool. It does not make decisions for you, does not provide professional advice, and does not replace human judgment. You remain the sole decision-maker for all actions you take.

1. Interpretation and Definitions

For the purposes of these Terms of Service ("Terms"):

Company refers to QDF AS, Henrik Ibsens gate 90, 0255 Oslo, Norway.
Service refers to the Tough Choice website and application available at https://toughchoice.ai.
User / You refers to the individual accessing or using the Service.
Decision Support Output means any content, options, perspectives, questions, comparisons, or informational material generated or displayed by the Service.

2. Nature of the Service – Decision Support Only

2.1 The Service provides informational, educational, and reflective decision-support tools only.

2.2 The Service:

does not make decisions;
does not recommend a single course of action;
does not provide medical, legal, financial, employment, or other professional advice;
does not predict outcomes or guarantee results.

2.3 Any Decision Support Output may be incomplete, inaccurate, biased, outdated, or inappropriate for your specific circumstances.

2.4 You remain solely responsible for:

evaluating the relevance and accuracy of any output;
deciding whether and how to rely on the Service;
all decisions, actions, and consequences arising from your use of the Service.

3. Explicit Exclusions (High-Risk Domains)

3.1 Health and Medical Matters

The Service does not provide medical advice, diagnosis, treatment recommendations, or risk assessments.

Any health-related content is provided for general educational purposes only and must not be used as a substitute for consultation with a qualified healthcare professional.

3.2 Employment and Hiring Decisions

The Service does not:

evaluate individuals or candidates;
rank, score, or recommend people;
automate hiring, rejection, or promotion decisions.

Any hiring-related content is limited to general frameworks, considerations, and reflective tools. You remain fully responsible for all employment decisions and for compliance with applicable employment and anti-discrimination laws.

3.3 Financial and Economic Decisions

The Service does not provide financial, investment, accounting, tax, or credit advice.

In particular, the Service does not:

recommend whether to buy, sell, rent, lease, borrow, lend, or invest;
assess affordability, creditworthiness, risk tolerance, or financial suitability;

The Service may present general considerations, trade-offs, or questions commonly associated with financial or economic decisions (for example, factors people often consider when choosing between buying and renting). 3.4 Legal, Regulatory, and Dispute Decisions

The Service does not provide legal advice, legal interpretations, or legal strategy.

In particular, the Service does not:

3.5 Safety-Critical, Emergency, and Crisis Situations

3.6 Mental Health Crisis and Self-Harm

The Service is not a crisis service and does not provide therapeutic care or crisis intervention. If you are in immediate danger, seek urgent help from local emergency services or a qualified professional.

3.7 Children and Minors; Parenting Decisions

The Service is intended for adult decision support and is not designed for use by children. The Service does not provide child safety, child welfare, or parenting advice in high-risk contexts (including suspected abuse, neglect, or violence). For such situations, contact qualified professionals or appropriate local services.

4. User Acknowledgment of Responsibility

the Service may influence your thinking but does not determine your decisions;
you act independently and at your own discretion;
the Company is not responsible for the outcomes of your decisions, to the maximum extent permitted by applicable law.

5. Accounts and Use

5.1 You agree to use the Service lawfully, responsibly, and only for its intended purpose as a decision-support tool.

5.2 You must not:

present outputs as professional advice;
rely on the Service for life-critical or legally regulated decisions;
use the Service in a way that violates applicable laws or third-party rights;
use the Service to discriminate, harass, or unlawfully profile others;
use the Service to facilitate harm to yourself or others, or to seek emergency/crisis instructions;
attempt to bypass, disable, or interfere with security or abuse-prevention mechanisms.

5.3 Security and Abuse Prevention

To protect the Service, its users, and its infrastructure, the Company may employ technical measures designed to prevent abuse, including computational challenges or similar mechanisms (such as proof-of-work).

You acknowledge and agree that:

such measures may require your device to perform limited computational work;
access to the Service may be delayed or restricted if these measures are not successfully completed;
these measures are used for security and abuse prevention purposes only and not for tracking or profiling.

5.4 We may suspend or terminate access if you materially breach these Terms or use the Service unlawfully.

6. Intellectual Property

All content, software, design, and functionality of the Service (excluding user-provided content) are the exclusive property of the Company and its licensors.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

The Company shall not be liable for any decisions made, actions taken, or outcomes resulting from your use of the Service or reliance on Decision Support Outputs.
The Company shall not be liable for indirect, incidental, consequential, or special damages, including loss of opportunity, loss of data, or personal or professional harm.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including (as applicable) liability for death or personal injury caused by the Company’s negligence, or for intent or gross negligence, or for any other mandatory statutory rights or remedies.

Where liability cannot be excluded under mandatory EU/EEA consumer law or other mandatory law, the Company’s liability shall be limited only to the minimum extent permitted by law.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied.

The Company makes no guarantee regarding accuracy, completeness, reliability, availability, or fitness for a particular purpose.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Norway.

If you are a consumer residing in the European Union or EEA, you may also benefit from mandatory consumer protections in your country of residence.

If you are a consumer in the EU/EEA, you may be entitled to use out-of-court dispute resolution mechanisms. Where applicable, the EU online dispute resolution (ODR) platform may be available.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in a reasonable manner before taking effect.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect and use personal data.
